1. DEFINITIONS
The terms used in these Regulations mean:
1.1. PASSWORD - a string of alphanumeric characters necessary to authorize when accessing the Account, determined independently by the Customer during the Registration process.
1.2. CUSTOMER - a natural person with full legal capacity, and in cases provided for by generally applicable regulations also a natural person with limited legal capacity; a legal person or an organizational unit without legal personality, which the law grants legal capacity, and which intends to conclude or has concluded a Sales Agreement or an Agreement for the provision of Electronic Services.
1.3. CIVIL CODE - the Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).
1.4. CONSUMER - a natural person for whom the conclusion of the Sales Agreement or contract for the provision of Electronic Services is not directly related to its business or professional activity.
1.5. ACCOUNT (CUSTOMER ACCOUNT) - a subpage of the Store, within which, among others, information about the Customer's Orders in the Online Store is collected.
1.6. PRODUCT - a movable item available in the Online Store which is the subject of the Sales Agreement between the Customer and the Seller.
1.7. REGULATIONS - these regulations of the Online Store.
1.8. REGISTRATION - a one-time activity consisting in creating an Account by the Customer, made using the registration form provided by the Service Provider on the Store's website.
1.9. ONLINE STORE (STORE) - the Service Provider's online store available at www.pdrsystems.eu through which the Customer may conclude a Sales Agreement or an Agreement for the provision of Electronic Services.
1.10. SELLER - KGO (business address: ul. Olchowa 63, 63-400 Ostrów Wielkopolski) entered into the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister responsible for economy, NIP 6222520252, REGON 381189723, e-mail address: kontakt @ pdrsystems.eu, phone number: +48 505 133 908 (fee as for a standard connection - according to the price list of the relevant operator).
1.11. PARTY - Service Provider, Seller or Customer.
1.12. SALES AGREEMENT (AGREEMENT) - a Product sales contract within the meaning of the Civil Code concluded via the Online Store.
1.13. ELECTRONIC SERVICE - a service provided electronically by the Service Provider via the Online Store.
1.14. SERVICE PROVIDER - KGO, Business address: ul. 1.15. ORDER - the Customer's declaration of intent aimed directly at the conclusion of the Product Sales Agreement and specifying its essential terms.
2. GENERAL PROVISIONS
2.1. The provisions of these Regulations are not intended to exclude or limit any rights of the Customer who is also a Consumer under the mandatory provisions of law. In the event of non-compliance of the provisions of these Regulations with the above provisions, these provisions shall prevail.
2.2. The Regulations define the rules for using the Online Store by Customers.
2.3. These Regulations are the regulations referred to in Art. 8 of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended), and also regulates the conditions for concluding Sales Agreements in the Online Store.
2.4. The Online Store is run by: KGO, Business address: ul. 2.5. The Service Provider provides the following Electronic Services via the Online Store:
2.5.1. Customer Account in the Online Store;
2.5.2. An interactive form that allows customers to place an Order in the Online Store.
2.5.3. Newsletter
2.6. The minimum technical requirements necessary to work with the ICT system used by the Service Provider:
2.6.1. A computer with Internet access;
2.6.2. Access to e-mail.
2.6.3. Recommended monitor resolution: 1600x1200 pixels;
2.6.4. Internet browser: Internet Explorer version 7.0 or newer with enabled JavaScript and cookies; Mozilla Firefox version 3.0 or later with JavaScript and cookies enabled; or Google Chrome 8 or later.
2.7. The Customer is prohibited from providing illegal content.
2.8. The customer is obliged to enter data in accordance with the facts.
2.9. The Customer is obliged to use the Online Store in a manner consistent with the law and morality with respect for personal rights and intellectual property rights of third parties.
2.10. In order to ensure the security of the transmission of messages, the Service Provider takes technical and organizational measures appropriate to the degree of threat to the security of the Electronic Service provided.
3. PROVISION OF ELECTRONIC SERVICES
3.1. As part of the Store, the Service Provider undertakes to provide Electronic Services to the extent specified in these Regulations.
3.2. The provision of electronic services by the Service Provider is free of charge.
3.3. Conditions for concluding contracts for the provision of electronic services:
3.3.1. The contract for the provision of Electronic services consisting in maintaining a Customer Account in the Online Store is concluded at the time of Registration.
3.3.1.1. To register, it is necessary for the Customer to provide the following data in the registration form, name and surname, address (street, house number, city and postal code), e-mail address, contact telephone number and Password.
3.3.2. The contract for the provision of electronic services consisting in the provision of an interactive form that allows placing an Order in the Online Store is concluded at the time of starting to use the above Service (adding the Product to the basket).
3.4. The contract for the provision of Electronic services consisting in maintaining a Customer Account in the Online Store is concluded for an indefinite period.
3.5. The contract for the provision of Electronic services consisting in the provision of an interactive form that allows placing an Order in the Online Store is concluded for a definite period of time and is terminated upon placing the Order.
3.6. Terms of terminating contracts for the provision of Electronic Services:
3.6.1. The customer may terminate the contract for the provision of electronic services concluded for an indefinite period at any time and without giving reasons, with a 14-day notice period.
3.6.2. The Service Provider may terminate the contract for the provision of Electronic Services concluded for an indefinite period in the event that the Customer objectively grossly or persistently violates the Regulations, in particular when providing illegal content. Violation of the regulations must be objective and unlawful. The termination may be submitted after at least one unsuccessful request to cease or remove violations with the appointment of an appropriate deadline. In such a case, the contract is terminated with a 14-day notice period.
3.6.3. Termination of the contract for the provision of Electronic Services concluded for an indefinite period by either Party does not infringe the rights or benefits acquired by the Parties during the term of the contract.
3.6.4. Notwithstanding the above provisions, the Parties may terminate the contract for the provision of Electronic Services at any time by agreement of the Parties.
4. CONDITIONS FOR CONCLUDING A SALE AGREEMENT
4.1. Announcements, advertisements, price lists and other information about the Products provided on the websites of the Online Store, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract within the meaning of art. 71 of the Civil Code.
4.2. The Product price shown on the Online Store website is given in Polish zlotys and includes all components, including VAT and customs duties. The prices of the Products, however, do not include delivery costs, which - if any - are indicated when placing the Order and are available on the Online Store website at: www.pdrsystems.eu/koszty_dostawy
4.3. The Product price shown on the Online Store website is binding at the time of placing the Order by the Customer. This price will not change regardless of price changes in the Online Store, which may occur for individual Products after the Customer places an Order.
4.4. In order to conclude a Product Sales Agreement using an interactive form, go to the website of the Online Store, select the Product and submit an Order using the interactive form based on the messages and information displayed to the Customer.
4.4.1. When placing the Order, the following data necessary to place the Order should be provided: name and surname, address (street, house number, town and postal code), contact telephone number, Product, quantity of the Product, place and method of delivery of the Product, method of payment.
4.5. Placing an Order via the interactive form takes place when you click on the form "PLACE AN ORDER WITH OBLIGATION TO PAY".
4.6. After placing the Order, the Seller immediately (1) confirms its receipt, which binds the Customer with his statement and (2) accepts the Order for execution - at this point, the Sales Agreement is concluded. Confirmation of receipt of the Order and its acceptance for implementation takes place by sending the Customer an appropriate message to the e-mail address (e-mail address) provided when placing the Order.
4.7. When placing an Order using the interactive form - until the Order is placed - the Customer has the option of modifying the entered data. To do this, follow the displayed messages and information available on the website of the Online Store.
5. DELIVERY
5.1. The Seller will deliver Products according to the Customer's choice
5.2. Product delivery is available on the territory of: the Republic of Poland.
5.3. Delivery costs will be clearly indicated during the ordering process and are available on the Online Store website at: http://www.pdrsystems.eu/
5.4. The recipient is obliged to check the external condition of the package in the presence of the courier who delivered the package. He is also obliged to verify the delivered package in the presence of the courier in terms of quantity and possible damage. Any discrepancies between the content and the external condition of the package with the order should be recorded in the damage report of the shipment with the indication that it was verified in the presence of the courier at the time of receipt of the shipment.
5.5. Any reported damage or non-compliance of the received goods will be considered negatively if the damage report is not drawn up in accordance with point 5.4.
6. PAYMENT
6.1. The seller provides the following payment methods:
6.1.1. By bank transfer (the Seller's bank account details are indicated on the Store's website and in the e-mail sent to the Customer after placing the Order).
6.2. The Customer is obliged to pay the price under the Sales Agreement within 7 days from the date of its conclusion, unless the Sales Agreement provides otherwise.
6.3. In the case of Customers who are not Consumers at the same time, the Seller has the right to limit the available payment methods, including requiring a prepayment in whole or in part.
6.4. The entity providing online payment services is Blue Media SA

6.6. The seller refunds the payment using the same method of payment as used by the consumer, unless the consumer has expressly agreed to a different method of return, which does not involve any costs for him.
6.7. The order processing time is counted from the moment of obtaining a positive payment authorization.
7. MODE OF THE COMPLAINT PROCEDURE
7.1. Complaints for non-compliance of the Product with the Sales Agreement
7.1.1. The Seller is liable to the Customer who is a natural person who purchases the Product for the Product's non-compliance with the Sales Agreement to the extent specified in particular by the Act of 27 July 2002 on special terms of consumer sales and amending the Civil Code (Journal of Laws No. 141, item 1176 as amended).
7.1.2. Complaints for non-compliance of the Product with the Sales Agreement may be submitted in writing to the following address: KGO, ul. Olchowa 63, 63-400 Ostrów Wielkopolski or via e-mail to the following address: kontakt@pdrsystems.eu.
7.1.3. The seller will respond to the complaint immediately, no later than within 14 days. The Seller's response to the complaint is sent to the address provided by the Customer or in another manner provided by the Customer.
7.1.4. The Seller informs that in the case of Products also covered by the warranty, the rights in this respect should be exercised in accordance with the conditions set out in the warranty card. The warranty for the sold Product does not exclude, limit or suspend the Customer's rights under the Seller's liability for non-compliance of the Product with the Sales Agreement to the extent specified by the Act of July 27, 2002. on special conditions of consumer sale and on the amendment of the Civil Code (Journal of Laws No. 141, item 1176, as amended).
7.2. Complaints related to the provision of Electronic services and other complaints related to the operation of the Online Store
7.2.1. Complaints related to the provision of Electronic Services and other complaints related to the operation of the Online Store may be submitted in writing to the address KGO, ul. Olchowa 63, 63-400 Ostrów Wielkopolski or via e-mail to the following address: kontakt@pdrsystems.eu.
7.2.2. It is recommended to provide in the content of the complaint as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of the irregularity and contact details - this will facilitate and speed up the consideration of the complaint by the Service Provider.
7.2.3. The complaint will be considered by the Service Provider immediately, no later than within 14 days.
7.2.4. The Service Provider's response to the complaint is sent to the Customer's e-mail address provided in the complaint or in another manner provided by the Customer.
8. PERSONAL DATA
8.1. The administrator of the Customer's personal data collected via the Online Store is: KGO, Business address: ul. 8.2. The Customer's personal data collected by the Administrator via the Online Store is collected in order to implement the Sales Agreement concluded with it or the contract for the provision of Electronic Services.
8.3. The customer has the right to access their data and correct them.
8.4. Providing personal data by the Customer is voluntary, but failure to provide the personal data indicated in the Regulations necessary to conclude a Sales Agreement or a contract for the provision of Electronic Services results in the refusal to conclude this contract. The data necessary to conclude a Sales Agreement or a contract for the provision of Electronic Services are also indicated each time on the website of the Online Store.
9. FINAL PROVISION
9.1. Agreements concluded through the Online Store are concluded in Polish.
9.2. In matters not covered by these Regulations, the provisions of the law in force in the territory of the Republic of Poland, including the Civil Code, the Act on the provision of electronic services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended); The Act on the protection of certain consumer rights and liability for damage caused by a dangerous product of March 2, 2000 (Journal of Laws No. 22, item 271, as amended); Act on special conditions of consumer sale and amending the Civil Code of 27 July 2002 (Journal of Laws No. 141, item 1176, as amended) and other relevant provisions of Polish law.
9.2.1. The choice of Polish law does not deprive the consumer of the protection granted to him on the basis of provisions that cannot be excluded by contract, under the law that would be applicable in the absence of a choice, i.e. the law of the country where the consumer has his habitual residence and the entrepreneur
(1) pursues his business or professional activities in the country where the consumer has his habitual residence;
(2) or by any means directs such activities to that country or to several countries including that country; and the contract falls within the scope of this activity.
9.3. The Service Provider reserves the right to amend these Regulations due to the following important reasons: changes in the store's software, changes in the form of delivery, changes in the law affecting the method of providing services, changes in payment methods, changes in the scope, payment or form of Electronic Services provided, change of the Seller's address . The amended Regulations are binding on the Customers if the requirements specified in Art. 384 of the Civil Code (ie the Customer has been properly notified of the changes) and the Customer has not terminated the continuous contract within 14 days. Amendments to the Regulations will not in any way infringe the rights or benefits acquired by customers, in particular, they will not affect the placed or implemented Orders and concluded Sales Agreements, which will be implemented on the basis of the existing rules.
9.4. Customers can access the Regulations at any time via the link found on the main page of the Online Store and download it and print it out. The Regulations of the Online Store are available at: http://www.pdrsystems.eu/regulamin/ and are provided free of charge to the Customer (by electronic means) at his request.
9.5. Consolidation, security and making available to the Customer the content of the concluded Sales Agreement and the Agreement for the provision of Electronic Services takes place by making the Regulations available on the pages indicated in point 10.4
9.6. Disputes arising between the Service Provider, the Seller and the Customer, who is also a Consumer, shall be submitted to the competent common courts. Disputes arising between the Service Provider, the Seller and the Customer who is not also a Consumer shall be submitted to the court having jurisdiction over the seat of the Service Provider or the Seller.
